Ellisville mayor faced with impeachment, hires lawyer

Ellisville Mayor Adam Paul has hired St. Louis Attorney Chet Pleban to represent him in a complaint brought against him by Elisville resident Katie James, who claims the mayor violated city charter by ordering police to remove residents from City Council meetings.

At the Feb. 6 Council meeting, Paul called for the removal of Robert Srote, a current candidate for City Council and former mayoral candidate. At a Council meeting in 2012, Paul had asked for the removal of James.

According to the city charter, ?Neither the Mayor nor Council Members shall give any orders to any such officer or employee, either publicly or privately.? Requests for action, according to the charter, are to go through the city manager. The penalty for going against the charter is removal from office.

In a letter to City Clerk Catherine Demeter, dated Feb. 15, Pleban indicated that both Police Tim Felgate and City Manager Kevin Bookout were present during the Feb. 6 meeting. Pleban suggested that ?both neglected or deliberately failed in this duty? to protect the Council, to include the Mayor, and to ensure that order is maintained.

In a second letter, addressed to the charter enforcement commission, on Feb. 15, Pleban noted that the commission had given Paul until Feb. 18 to respond to James? complaints. Pleban requested a 30-day extension, until March 20, so that the office of Pleban and Petruska Law, LLC, could complete their investigation into the matter.

Pleban also made a motion at that time calling for the disqualification of Councilmembers Dawn Anglin and Michelle Murray from the Charter Enforcement Commission.

Anglin and Murray ran against Paul in the 2012 mayoral election.

Frustration has been evident within the community and inside Council chambers since before the 2012 election, spurred on by the decision of the Council to approve Tax Increment Financing for a Walmart superstore to be built on Manchester. To qualify for TIF, the corner of Manchester and Kiefer Creek roads had to be designated as blighted. Eminent domain was invoked to allow Walmart to take possession of the Clarkchester Apartments, displacing? about 250 residents.

A meeting of the Charter Enforcement Commission is scheduled for 5:30 p.m. on Monday, Feb. 18 at city hall.
